Terms of Service

1. Eligibility and accounts

You must have legal capacity to use the service and complete a purchase. Invited-account credentials are personal and must be kept secure. You are responsible for activity performed through your account unless you promptly report unauthorized access.

2. The HARCY design service

HARCY provides AI-assisted concept generation, image-based customization, private design storage, and a pathway to made-to-order production. AI outputs are previews, not final engineering drawings or guaranteed representations of color, scale, weight, gemstone appearance, or manufacturability.

3. Your content and permissions

You retain rights you hold in content you submit. You give HARCY a limited permission to host, process, reproduce, transform, and share that content with necessary service providers solely to operate the requested service, protect the platform, and complete your order. You must not submit unlawful, infringing, deceptive, abusive, or unauthorized content.

4. Verified templates and checkout

Only designs created from a verified HARCY template may be eligible for automatic Shopify checkout. Material, category, design level, quantity, shipping, taxes, availability, and the final price are confirmed in the checkout flow. A cart is not an accepted order until payment and order confirmation are completed.

5. Custom-made production

Each purchased piece is produced according to the confirmed design and selected options. Reasonable production tolerances may apply to dimensions, hand-finished details, color, texture, plating, and natural stones. We may contact you if a design requires adjustment for safety, durability, or manufacturability.

6. Prohibited conduct

• Do not bypass access controls, probe the service, automate abusive requests, or interfere with other users.
• Do not use HARCY to create illegal products, infringe intellectual property or privacy rights, impersonate others, or submit content without permission.
• Do not resell account access or misrepresent an AI preview as a finished HARCY product.

7. Availability and changes

We may maintain, update, suspend, or change features to protect security, reliability, legal compliance, and product quality. We do not promise uninterrupted availability. Confirmed paid orders remain subject to the order terms and applicable law.

8. Liability

To the extent permitted by law, HARCY is not responsible for indirect or consequential loss arising from use of an AI preview, unauthorized submitted content, third-party systems, or events outside reasonable control. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.

9. Governing rules

These Terms are governed by the laws applicable to the operator, without limiting mandatory consumer protections that apply in your place of residence. We encourage good-faith resolution through the customer-support route before formal proceedings.
